IRC Nominations: The Arizona Independent Redistricting Commission (IRC) Seeks Applicants for Appointment

What can we do about gerrymandering? In Arizona, we made major reforms in 2000 via voter initiative. The Arizona Independent Redistricting Commission was created by amending Arizona Constitution, Article IV, Part 2, Section 1 and tasking the Commission on Appellate Court Appointments with nominating candidates for appointment to the IRC.

If you have an opinion about the best way to draw fair districts, and/or are inspired by the United State’s Supreme Court’s decades-long struggle, most recently highlighted in Rucho v. Common Cause, 139 S. Ct. 2484 (2019), then you should apply for the IRC. It’s clear that voters can be targeted better every ten-year redistricting cycle as big data evolves, the key question is, who should draw the district lines with that data? You can. Arizona leads the way with the IRC, and our way of doing things continues to be held up as a model for other states to follow. Apply!

Members must be:
• Arizona registered voters who have not changed parties for the last three years (2017-2020);
• Not elected or appointed to, or a candidate for any other public office including precinct committee person within the last three years, but excluding school board members or officers. See this link if you have questions about whether information in this step applies to you here.
• Cannot have served as an officer of a political party or a candidate’s campaign within the last three years;
• Will be barred from serving as either a public office or an officer of a political party or candidate campaign committee three years after appointment (2020-2023);
• Ineligible for public office or a registered paid lobbyist during their term and for three years thereafter (2033)

The Commission on Appellate Court Appointments is currently accepting applications for a new Independent Redistricting Commission. The complete application form and all attachments must be received by 5:00 p.m. on August 20, 2020 at the Administrative Office of the Courts, 1501 W. Washington, Suite 221, Phoenix, AZ 85007. Applications received after this deadline will not be considered. Incomplete applications will not be considered. IRC members are appointed for an approximately ten-year term, or until the appointment of the next redistricting commission (though your districting responsibilities should be over by 2022, when new maps are in use). Appointments for the new term occurs in each year that ends in one.

The application is available here. For more information, please contact Blanca Moreno at 602-452-3308 or via email at bmoreno@courts.az.gov

Arizona Citizens’ Clean Elections Commission

In 1998, the citizens of Arizona passed an initiative creating a new commission with four overlapping objectives: 1) voter education; 2) public financing for qualifying candidates; 3) campaign finance enforcement; and 4) overseeing the clean elections fund. Commissioners work with experienced and creative staff to ensure the proper management of programs, astute litigation management, and also what Commission staff considers the best part of the job: helping Arizonans vote! To that end, the commission works on voter registration efforts, held an educated electorate seminar, work with local elections officials, and host candidate debates, among other things. Learn more about the great work Clean Elections does here.

Generally, the board meets in Phoenix once a month, and for one to three hours, depending on the issues that occurred in the previous month. The Commission may need to call a special sessions or two in a year, but they have historically been infrequent. The terms are five-year terms. Must be qualified to vote, not be precinct committee member, or other official in a political party. You may be appointed by the Governor, the Secretary of State, or the ranking member of the Senate and/or House, as the nomination process starts.

Contact Trista Guzman Glover, the Director of Boards and Commissions at the Governor’s office at 602.542.2449 or email bc@az.gov. Applications are available here.

Arizona Supreme Court Committee on Character and Fitness

Purpose: The Committee members are responsible for the investigation and recommendation of applicants for admission to the practice of law in Arizona. The Committee reviews approximately 500 applications per year. In addition, Committee members attend inquiries and hearings concerning applicant qualifications.

Openings: Several appointments will be made by the Arizona Supreme Court. The State Bar Board of Governors is asked to submit three nominations per opening to the Court for its ultimate selection.

Candidate Criteria/Qualifications: Committee members must possess the time, skill and patience to review confidential detailed reports of background investigations into financial, criminal, civil, employment, disciplinary and academic matters. Committee members must have the ability to marshal and present evidence, examine witnesses and write clear, concise and well-reasoned findings and recommendations when required. Committee members must understand the importance of applying the Supreme Court Rules pertaining to this process consistently and fairly. Communication with Court staff and other Committee members is encouraged and expected. Applicants should describe prior experience with regulation or discipline of professionals, and their views on the observance of an attorney’s professional ethical obligations, on their application. Applicants who currently serve or have served within the past two years as law school faculty (including adjunct) at one of Arizona's accredited law schools shall not be considered if such service could give rise to significant conflicts of interest regarding their duty to the Supreme Court to review and evaluate the character and fitness of their current or former students.

The Committee conducts at least one hearing monthly in Phoenix. Members are randomly selected and if chosen are expected to participate in assigned hearings. Members must also participate in one or more informal inquiries per month. In addition, each member is assigned several applicant files for independent review each month. Between file review and hearings/business meetings, members devote an average of 25 hours per month to their Committee responsibilities. Due to the time sensitive nature of the admission process, file assessments and associated written outcomes are expected to occur within a two week turn around from receipt on most matters. Mileage is paid for any members residing outside Maricopa County, but there is no other compensation for service as a Committee member.

Term: Initial appointment of four years, with the possibility of reappointment.

An application form here must be submitted to the State Bar by Wednesday, September 2, 2020. For additional information contact Carrie Sherman at 602.340.7201 or Carrie.Sherman@staff.azbar.org.

Foster Care Review Board (FCRB)
The Arizona Legislature established the Foster Care Review Board in 1978 in response to concerns that Arizona’s foster children were being "lost" in out-of-home care and staying too long in temporary placements. The primary role of FCRB is to advise the juvenile court on progress toward achieving a permanent home for a child involved in a dependency action and in an out-of-home placement. As one of the first states in the nation to establish citizen review boards, Arizona's system is housed within the Dependent Children's Services Division of the Arizona Supreme Court, Administrative Office of the Courts.

There is at least one board in each county reviewing the cases of children in that county, and several boards in the more populated counties. A board is established for every 100 children that need to be reviewed. The presiding juvenile court judge in each county establishes new boards by an order, and appoints volunteers to a specific board. There are currently 146 boards in Arizona, including 79 in Maricopa County.

The State Foster Care Review Board reviews and coordinates board activities and establishes training programs for board members. The State Board makes recommendations to the Arizona Supreme Court, Governor and Legislature regarding foster care statutes, policies, and procedures.

If you are interested in applying for one of the Foster Care Review Boards, you must complete an application, have fingerprints taken, and pass a background check. Appointments are usually for three years, unless a member is appointed to fill a vacancy that has occurred prior to the expiration of a three year term. The presiding judge is required, to the maximum extent possible, to ensure that each board represents the socioeconomic, racial and ethnic groups of the county in which it serves.
